I have public defender, the district attorney for the other guy is trying to pin me with new charges, my lawyer didn't stand up to defend me, new court date has been set, giving the other guy a chance to get out of jail. What should I do?
If you are not happy with the representation you are receiving, you need to retain another Attorney. If you can't afford another Attorney make an appointment to speak with your Attorney to discuss the evidence and why you feel your best interests aren't being represented. I suggest you exercise your constitutional right to a jury trial and allow the evidence to be presented to and reviewed by a jury. Good Luck!
Though tired, the aphorism 'possession is 9/10's of the law' definitely rings true. Though I only practice in Michigan, I'd imagine issues about possession come up in ALL jurisdictions. Innocent people always need a gladiator in their corner to work up a trial strategy. Where I practice possession can be, I believe, actual or constructive. This means it can be shown you actually possessed the contraband or had the ability to. Usually these are cases of inference. Unfortunately, the unscrupulous person who pinned the goods on you probably won't step forward and take the blame. If you're not happy with your attorney I'd hire someone else before court. Good luck
