I have filed a complaint against my child's school with OCR; now I am subject to retaliation. I requested from the 504 coordinator how to file an internal retaliatory compliant and it has been eight days I have received no answer. Is this not again retaliation? I want to write an email to the superintendant but I want to make sure if this can or cannot be considered retaliation? How many days do they have to inform me of the complaint process?
You should file an additional complaint or add to your current complaint with OCR a retaliatory action. Retaliation for asserting your legal righst is illegal under Section 504 and under the Individual with Disability Act. I do not practice in your state, but both these laws are federal.
