I was renting out a room in my house to a tenant. A month to month lease agreement was made that stated there had to be 30 days notice or otherwise pay $600 (last months rent). The renter moved out without any notice because they entered another renters room unauthorized and found that they keep snakes as pets. The renter didn't ask any details about the situation but instead wrote a letter stating that the snakes were "potentially harmless and disturbing" so for that reason was moving out day of. The individual is demanding the damage deposit back (understandable no damage was done) but the last months rent as well, due to this information not being disclosed upon signing the lease. I believe I had no need to disclose that another renter owns snakes seeing as they are in fact not venomous and it is the other renters personal business. As a landlord am I in the right to keep the last months rent as long as I notify that I am doing so?
If they left in the middle of a rental period or otherwise didn't give you 20 days notice before canceling the lease you should be alright to hold on to the full rent for the last month they were in the unit
If they gave less than 20 days notice before the end of the rental period (usually the last day of the calendar month), they are still responsible for the rent until the end of the next month. So if they moved out on the 15th of January, they owe the full rent for February because the law still considers them as the tenants until the end of the February rental period.
If they left on or before the 10th of the month, thus giving you 20 days notice before the end of the rental period, they only owed the rent for the month they left in.
Their discomfort with snakes is not a violation of the warrant of habitability that I've ever heard of, so it shouldn't come into play.
