How do I seek a court order to remove a secondary name from a car title? The second person has stated he has no interest in the car but I have been unable to locate him for a year. The car is in my possession. I have solely paid all the car notes and insurance payments. Now I need to sell the car but cannot do so without the second party's signature who I am unable to locate. What type of information should I include in the court petition to convince the judge?
You cannot remove a co-owner of a vehicle from the title unless they sign the back of the title over to you so you can get a new title solely in your name. You cannot sell the car without them signing the title. It makes no difference that you made all the car and insurance payments.
