my cousin installed an app on her phone to record and then listen of all the conversations between her son who is 10 with his uncles, father, etc. I read that she may be violating the law since nobody has giving her any consent to do so. However, she said that she is the primary custodian of her child and she is giving him consent to his kid to record all phone calls with others .Of ourse the child has not clue what is going on and he has not give any permission to anybody..Is my cousin breaking the law?
Normally, third party calls on not permitted to be recorded without the knowing consent of the parties, only calls to which one party or the other are on the phone with one other person. I cannot say whether this applies to a parent recording her child's calls. As this is more of a criminal or constitutional law issue I am reposting it.
