I heard that the USCI is offering to recapture time spent out of the US while on R-1 visa. I got my visa in May 2007. My first entry to US was in July 2007 and departed in September 2007. My second entry was in June 2008 and exited for a month in February 2009.
I filled I-360 which is pending now. Can I file to recapture time on R-1 with a petition of I-129 while I-360 is still pending? If my visa and I-94 expires, will I accrue unlawful presence or I am ok till the outcome of I-360 petition? Can someone please advise me because time is running out. Thanks.
