Ex husband and I divorced in 2004 and I refinanced my home in 2005 and he signed a quit claim deed. Is his name removed from the deed? Also, I remarried in 2007. My current husband is not tied to the loan of my house, but has signed bank papers when I refinanced again in 2009, stating he has an "interest" in the property. He is concerned that my ex husband's name is still on deed of house and if I were to pass away unexpectantly, he would have issues with getting the house. Does he have to worry and is my ex off of the deed?
As long as the Quit Claim deed from your ex husband was recorded than he has no claim. It most probably was recorded or you would not have been able to refinance the house in 2009 without his signature on the mortgage. The mortgage company had your present husband sign on the mortgage in the 2009 refi because even though he does not have a "legal" ownership interest he has an "equitable" interest in the house since it is his primary residence.
