Contact the Labor Department to file a complaint, but you don't get paid for time you didnt work.
This response is only general information and is not legal advice. It does not form an attorney-client relationship and should not be relied upon to take or refrain from taking any action. You should seek a qualified attorney before taking any action related to your inquiry.
An employer is not required by law to pay out sick time. You would be entitled to waiting time penalties of one day's pay for each day the employer is late paying your final compensation up to a max of 30 days.
Employers do not have to pay employees for unused sick leave upon termination, but they do have to pay for earned and unused vacation pay if applicable. If the employer "willfully" withheld your final check after the date of termination by the employer, you can get one day's pay for each day you have to wait to be paid - up to 30 days' pay and the law states that the employer "shall" pay your attorney. Call an employment law attorney to discuss having the attorney send a demand letter to your former employer to get what is owed to you. Find contact info on Avvo.com.
