I am a non resident alien when I sold few of my share holdings through ESPP. I attempted to report them during my tax filing however I got a note from my brokerage that since I am a non resident alien, I filled up W8 BEN (instead of W9) and so they did not report the sales to IRS.
Should I report my sales during tax filing (and pay any tax for the sale income) though I am a non resident alien?
I am from India under H1B and my total sales is approx 25,000 USD.
You will need to report on your income tax return any sales. If you made a profit there will be some income tax to be paid either short or long-term capital gain. Or if you lost money you'll have a long or short-term capital loss. Generally $3000 of your losses can be used to offset ordinary income.
