4 years ago I got charged with a theft misdemeanor. I had community service, a theft class fines and a deferred sentence so it is no longer on my record and Visible to community but obviously in court
I made the stupid choice to do it again. I have court next month and it will be another petty theft charge. My question to you all is what am I looking at for this second offense. i was told less likely jail time. It was 1 item costing 150. Also is it possible to get another deferred sentence or my record sealed eventually? What should i expect?
Well the court gave you a break last time and you didn't learn your lesson. Don't expect the same result. You might not get jail time, but I would say another deferred sentence is highly unlikely. You will need an excellent defense attorney.

Agree with my colleague. Prosecutors will almost never consider a deferred judgment and sentence if you were given that option previously. You have a good shot at a non-jail plea, though it might involve probation, including a theft class. It really depends on your jurisdiction. If you plead guilty to a straight (non-DJ) theft in state court, you will not ever be able to seal it. If you are in a municipal court, you can petition to seal that conviction three years after the case is completed (including any sentence); but the District Court would consider your prior theft DJ when considering whether to seal it.

You are likely to to receive the same option of a deferred sentence the second time. I would consult with an attorney so they can present as much mitigation as possible to the DA in an effort to keep you out of jail and if you are really lucky prevent a permanent conviction.
