I'm a US Citizen and filing i-130 and i-485 for my wife who is in US under F-1 Visa. We married a month ago. I'm confused about what to put for the last name of my wife. Her passport, i-20 , birth certificate and marriage certificate shows her maiden name. However, she and I want to use her married name on the EAD and Green card. Is it okay to put married name in the application form?
An immigration attorney is the best person to answer this question.
The answers provided in this forum by me and transmitted by users of this forum are not to be considered legally binding in any way, nor is there an intent to form an attorney client relationship. If further information is required, seek competent legal counsel.
Yes and no. You can use the married name, but you should understand the implications of doing so. Especially now with "extreme vetting" and intense review at all immigration offices, you would be wise to work with a lawyer.
