The frame is twisted the radiator is not mounted correctly the strut bracket is not there. Supension is bent up. I gave him 1800.00 down and i am making payments. Do i have a chance on getting money back?? Found out car had been totaled at one point. Unsafe to be on road be mechanics.
Do you have a chance? Yes. Can you get it without going to court? Most likely no. When you buy a car from a private party, the usual protections applicable to a consumer-merchant transaction do not apply, and the consumer protection laws do not apply. So your only choice is to sue to undo the deal, which does not provide for recovery of attorney fees. In situations like this, I, for example, charge people 10% of the price of the car, and some of them prefer to attempt to recover 90% rather than keep their coffin on wheels.
Definitely have to sue him to have any chance. Might not be cost effective.
