My Fiance got a PV for driving under suspension 4 times since sept. He is on probation for F-5 theft. He is under the diverson program so he hasnt been convicted of it. What time is he facing? Were supposed to get married on Thursday, Should I cancel? He has paid all his fines on time and has never missed a meeting with his PO and has never dropped dirty. He has Court at 130 Monday what should I do?
You need to immediately contact your fiance's lawyer or hire him the best one you can find. He is in serious trouble.
The fact that he is in a Diversion Program give him no special consideration. Diversion is a combination of Probation and Rehabilitation at the same time. So if I understand your situtation accurately, he got four separate DUS citations while he is in Diversion/Probation. This almost guarantees him jail or prison, unless the Judge goes completely against the typical response.
I would hold off on the wedding, as I suspect he will likely be going to jail on Monday. The fact that he has paid his fines, been clean, attending meetings, etc. is good, but four separate DUS citations sends a signal to the Judge of "I really don't care if I get caught DUS. I am in Diversion and I am gonna do what I wanna do. Sorry!" This is the wrong attitude to take. The Judge can give him 0-12 months in jail or prison for this offense. He should be ready for that very likely result. A good lawyer may be able to postpone his case long enough for him to obtain a valid OHDL which would be a great thing!
