Is it possible to expounge a theft 3 gross misdemeanor two years after the sentencing or two years after the date the fines were fully paid (which were applied after sentencing)? I know it is possible to expounge 2 years after the fact, but which one? Conviction in court happened in january of 2009. Thank you!
If this is not a conviction, it is possible to remove the non-conviction record 2 years after it becomes a non conviction. An example of this would be a deferred sentence that ethe entually resulted in a dismissal. Two years after the date of dismissal you could petition the washington state patrol to remove the information.
In your case that sounds like it was a conviction in 2009. In order to be eligible to vacate and dismiss a conviction you must wait 3 years after the case is completely closed ( probation ended and all fines paid). Usually this is 2 years after the date of conviction. If the case was closed in 2009 you maybe eligible now. If the case was not closed until 2011 you will have to wait until 2014.
