So I was sued for defamation for a bad review on a review site. They went unlimited civil for the defamation. I ended up agreeing to just taking down the review and paying them $3000 as well as agreeing to publicly denounce myself on the site (I did not want to deal with hiring a lawyer and had no time to handle this with family issues, so I let them bully me) though a settlement agreement with their lawyer. Their lawyer confirmed that I did my part, and my check was cashed. He said he will dismiss it when he can. He has not responded since after countless emails. I am heading to my case management conference next week (that he filed for a month a go for some reason). What am I to do?
Appear. Bring evidence of settlement and compliance and ask for dismissal with prejudice against
Go to the CMC (which is set by the judge, not the lawyers) and tell the judge the case has settled but that plaintiff has failed to dismiss. Depending on what the settlement agreement says you might want to tell the judge that each side has waived costs.
