What is the % chance of 1/ diversion or 2/ dismissal or 3/ infraction for a petty theft case in San Diego City PC 484, provided the followings:
1/ Police was called with handcuffed, citation, promise to appear and released.
2/ NO prior whatsoever
3/ Item value $150,
4/ No surveillance camera, only loss prevention testimony
5/ I was asked to sign a "Trespass" notice at store, on that piece of paper, the item taken was put down ( can this serve against myself as a guilty plead?)
Worried- please help explain.

The fact you are considering hiring a private attorney is a good thing as there are a few things that can be done before court in an attempt to prevent charges from being filed, or at the very least set the groundwork for a non-criminal conviction disposition.
Since you have no record, now is not the time to be penny wise about sparing yourself a theft related criminal conviction.
