I have petitioned my husband just waiting on his green card interview, in the meantime we decided to go ahead and petition his daughter (12years old) I (us citizen) understand I can petition her while her father waits for his green card interview. My question is, does her mother in their home country (Philippines) have to give some type of contest ?
If the child's mother has custody over the child, then the mother must agree to allow this child to get a passport and to immigrate to the U.S.

Not to file the petition, however, very likely ta release will be required before the child's government will permit migration.
Attorney Robert Brown's (former INS Director, 1972-99) reply to your question is general in nature, and does not constitute legal advice as all facts are known to him. For specific advice or representation you should retain an attorney experienced in immigration law. Mr. Brown's reply on AVVO does not create an attorney/client relationship not constitute legal advice.
