I came to the US back in 2003 EWI and got arrested by Cpb as i was crossing the border, they took me in and an Immigration Judge granted me voluntary departure, this hole process from my entry ewi and my voluntary departure took exactly 62 days. (So i was here for a total of 62 days).
Than, i came back in again in 2005 EWI but at this time i didn't get arrested, so i have been here since than which has been 15 years.
I have every single paperwork saying i was granted voluntary departure and also i have all the paperwork saying that i voluntary departure on time and every single proof as they may ask me for, (i did multiple foias),
My wife is an american citizen, am i able to adjust my status or i have a permanent bar?
Thanks in advance for your help!
Unfortunately, you could have a permanent bar. Even if you tried to adjust status, you would have to return to your country and then try to file a waiver based on hardship which is also very difficult.
