My son was in a major car accident in September that left him paralyzed. Tried to get pension was told employer made an era and put part time employee even tho he was full time over 5 years.. Also he opted out employer medical and was suppose to be compensated for opting out but never received any compensation. Employer wont respond to calls.
I redirected your question to the correct practice area.
I am very sorry to hear about your son’s accident and tragic injuries.
Your son appears to have some employment issues worthy Of investigating. It sounds like his employer may have some exposure - you should consult with and hire an experienced labor law attorney,
I am so sorry for your son's accident. The employer is liable for these mistakes. If you aren't getting any response from the employer, then I agree that your next step is to contact an attorney in PA who specializes in ERISA which is the federal law governing employer provided benefits. Good luck-
I am very sorry to hear about your son. I hope all the best for him.
The employer must make good on the benefit plan. But it sounds like you will need an attorney who practices employee benefit law. There are a number of them in the Philadelphia area you should be able to find on AVVO or through a general search of the internet. Good luck.
