I am a model agency based out of USA, I want to partner up with a model agency in Paris.
We have a regular e commerce client we want to book models for. All Paris agency models are European. All of my models are American.
What would be our transaction process?
I am the only one who can do wire transfer or credit card charge to our client (e comm brand) because french laws in Paris does not even allow you to do this.
I guess my question is, since my new agency partner can book agency models from her agency based out of France can we do the following transaction legally:
I charge the ecomm client from Portugal, I take my commission out of this, I send French model agency the model check + French agency commission. We would basically be doing business to business transaction.
Could I send the model her check and then the agency in French their part of commission separately?
Any advice or lead would be super helpful
I am a french Jurist and NY based corporate attorney. There is many ways to skin the cat. (and I am against fur), you may open a new entity in partnership with your French partenaires and incorporate it in the US, the company will receive all payments as an LLC and disburse them to France as partnership split, the portion of taxes not paid in the US will be owed in France.
or vis versa.
You will need an llc and btw you could even get a visa for your french partners here based on the level of investment E2 visa.
you could also receive all the payment not be taxed on it and issue a 1099 to the French entity and make payment on receivables.
and many other ways.
all you doing seems perfectly legal as long as you comply with tax laws and requirements.
