I purchased p90x product from an online supplier. I sold most of them on ebay and it's been about a month since I last sold one. Now I get an EMAIL from a law firm stating my p90x was counterfeit. They are asking for almost $900 to be paid within 10 days to the law firm. It's a scanned letter and my address is on it but not complete, and when I called the firm a girl answered at 10pm at night.
First of all, why would they send an e-mail and should I do anything or wait for a real hardcopy of a letter? The law firm seems legit, but I don't get why I would get an e-mail as oppose to a real letter from them. And why would someone answer the phone so late at night?
I wouldn't mess around with this. (I don't know what p90x is but assuming you sold it claiming it was a p90x product and it wasn't then yes you have a problem even if you weren't aware of it being a counterfeit. You may be able to bring in the party who sold it to you ("implead") as a counterfeit but you would be responsible to your buyer for the misrepresentation.) I would first do some searching online to see if you can confirm this is a legitimate law firm and attorney. It is possible the attorney has a home office and this is why someone answered at 10 at night or, believe it or not, some of us are working past 10 at night sometimes.
Then, get an attorney and explain your situation and see what can be done. Be careful because anything you say about the case could potentially be used in litigation. Good luck.
