Have paid 20 years of 30 year mobile home mortgage living on parent's land, but parent has passed away and land is being subdivided. I am not behind or late on payments. What are my options? Can I forfeit home without being sued by mortgage company? Can they take my assets or my wife's assets (she is NOT on mortgage)? If I inherit some of the land can they take it? If new home is purchased before estate is probated can the mobile home mortgage company cause any problems with that process?
I take it you mean who owns the real estate now that your mother has passed. That depends, in part, upon whether she had a last will and testament or not. There may be mortgagees whom have an interest in the real property. Consult with probate attorney for an opinion.
