A 16 years old child minder had been slapping the children in her care with a wooden stick as a discipline. The children also has some serious bruise. So over what age can a person be charged with child abuse?
RCW 9A.04.050 addresses the issue of people capable of committing crimes and the capability of children by saying, in pertinent part, the following:
"Children under the age of eight years are incapable of committing crime. Children of eight and under twelve years of age are presumed to be incapable of committing crime, but this presumption may be removed by proof that they have sufficient capacity to understand the act or neglect, and to know that it was wrong...."
