We have seen his camera aimed at our backyard from his upstairs room next to his computer. When my wife has noticed it she makes a gesture and he responds by hiding or turning off the lights. Last night another man was in the room when it happened, and once she let them know she saw them one dove for the floor and turned off the lights. This is very intrusive and violating our privacy. What can be done?
Questions about neighbors using video recording devises are asked frequently on this site.
These cases are all fact sensitive and there is not subsitute for having an attorney sit down and review all the facts and circumstances.
One question is what is the neighbor doing with the recording?
Generally, a neighbor can record where there is not reasonable expectation of privacy. This includes backyards and any place where the neighbor could see you when they are not trespassing.
You have an attorney send a cease and desist letter. You could also call the police and file a report.
