My brother was masted for bascially sleeping at his desk (3rd masting but all were pretty minor things nothing criminal) and has now been told by his chief that his discharge papers are ready and that he is getting an other than honorable discharge. It doesn't seem like this would be correct from everything I have read about OTH discharges. What will this mean for him as far as getting a job? How hard is the upgrade/appeal process on something like this if he gets a good lawyer? Can he get his GI Bill and other benefits back? He served for 8 years in the Navy.
That seems a little rough to get an OTH for sleeping at his desk. An OTH will certainly have a major negative impact on future employment.
It is very difficult to get an upgrade in discharge.
The Navy Discharge Review Board can review your record. They can look at your service as well as consider your version of events. You can downloaded forms from Navy web-site: http://www.ig.navy.mil/. You can also contact the Veterans Administration for assistance.
Finally submit a copy of your DD293, "Application for Review of Discharge or Dismissal from the Armed Forces of the United States".
