In my case I have a motion, RFO hearing that I filed and is scheduled in three days, Wednesday. I want another matter heard on same day. It's not a grave emergency matter but a separate issue that needs to be addressed. Can I file an RFO, and request an OTS, so the issue can be heard on that court date, in three days, writing a declaration why etc., and is there enough time? Court hearing is in Alameda County, per the local court rules do I have enough time, 48 hours, if I file before 9am on Monday ?
Please refer to the California Rules of Court. I don't understand your time question.
I don't think a court will permit this for your convenience.
All of Ms. Straus’ responses to questions posted on Avvo are intended as helpful information based upon the facts stated in the question, and are not to be relied upon as a full or complete legal opinion. It may not be what you wished to hear, and it does not create an attorney-client relationship. Ms. Straus has been licensed to practice law in California for 30 years. Ms. Straus regrets to report that you cannot get contact information about her in any way, shape or form, as Avvo wont let you. Good luck.
You are not going to get the second matter heard on the same day. It must be an emergency (ex parte) and you stated it is not.
Also, the other side must have notice and an opportunity to be heard. Three days doesn't do that.
48 hours is for ex parte, but you stated this isn't a "grave emergency." You open yourself up to sanctions if you file a frivolous ex parte. Sounds like you are trying to make this convenient for you...the judge will not like that...not one bit.
Yes you need an attorney when your children are at stake! You could submit a Supplemental Declaration and address the other matter, explaining the situation. The issue is, will the other party find out in time about your Supplemental Declaration?
