I have a family to support, & need a job. My former employer (terminated after going to HR) is making it extremely difficult for me to get gainful employment. Do I have any options while a discrimination investigation is open with the Equal Employment? I hired a reference company to check my reference which confirmed my suspicions. My former employer is the only place I worked at since finishing school for Medical Billing, so a reference from this company is vital for me to gain employment. I need to work now. Any advice would be appreciative. I'm looking for something to prevent them from giving me a negative reference, so I can get a decent job to support my family. I'm looking for something simple at this time, but effective!
I would contact an employment / discrimination attorney as soon as possible. At least have a free case evaluation with an employment / discrimination attorney so they can explain your options. Usually an attorney can help negotiate settlement terms such as a neutral reference agreement. They can also help you through the EEOC process.
A strong letter written by an attorney putting them on notice of your further retaliation claim is likely your best course of action. Of course, you can't prevent them from saying what they want and can, instead, only respond with legal action. If they know you know the information they are providing and it gets to their legal counsel they may change what they are doing. Best of luck.
