I got an H1B(which expires in 2018), buth then my company closed down and I applied to a different employer. My H1B transfer was rejected and I had to leave the US. I'm considering an MBA which would grante me 12 months of OPT. When I apply for a OPT to H1B transfer, would I be subject to the cap, or would I be cap-exempt because my H1B expires in 2018?
It depends on how much time you have exhausted in H1B status
