NYS - unwed single mother with 7 month old. Father not on birth certificate - became a degenerate (no job, addict), both mother and father are good with arrangement. Father saw child once at 3 days old in hospital. Father does not want to sign away parental rights because he thinks acknowledging them to sign them away will make him liable to child support. I don't need a dime from him. I want to travel to Ireland with my son and although getting a passport is not an issue, many of the travel blogs say I should get a document from the court stating I am his sole custodian. Just called the court and the court says paternity has to be established first (even if I have no idea who the father is). Is there any way to get a court document saying "In NYS unwed mothers with no father on birth certificate are given custody, this is such a case"
I would suggest you schedule a consultation with a family law attorney about filing a petition seeking sole custody of your child.
