mom who only sees her son 2 days a week per agreed order. this case has dragged out because my baby father has a lawyer. he is fighting for child support and spend more time with the child. his attorney mailed me a document stating that i was served for intent to relocate. thats all it said and nothing else. it said service and that the baby father intends to relocate with child. i have been going by myself with no lawyer and have been ok. what do i do. thank
You should do all you can to hire an attorney on such an important issue. If he is permitted to relocate then it will be difficult to see your child unless you come up with a fair agreement on parenting time or succeed in blocking the move which will be difficult without a seasoned local Florida attorney. Section 61.13001, Florida Statutes controls this. You can read it and if you understand what it says you can follow its requirements. There are time limits and if you do nothing you can inadvertently agree to the relocation.
My sincere advice is that if you do not want the move to occur, you need to hire a lawyer as soon as possible.
I agree with Mr. Peppler. You need to read Fla. Stat. 61.13001. It is not terribly complex. The statute states what he needs to show/prove for the court to allow the relocation. You need to show the opposite. Also, he should have filed a proposed Parenting Plan. You need to object to the relocation ASAP (again read the statute for what you need to do).
