Bear with me. Ok, a friend of mine is going through a contested divorce. She was the plaintiff. There are children involved. After about a year and a half of "appearances," there was a disposal. A"Stipulation of Discontinuance." Ok, about 2 months later, he (now the plaintiff) filed for a "Notice of Automatic Order." I'm confused...was the divorce withdrawn? Or are the divorce proceedings still in progress? Any help would be amazing.
The stated facts are insufficient for a clear understanding of what is doing on. My best quess is the wife commenced a divorce and then discontinued it or to have the husband turn around and start a new divorce action which includes the automatic orders. Your friend needs to consult with an attorney asap.
There are two divorce here. The first was filed by the wife who discontinued it. The action was no longer of any force or effect. Later, the husband bought a new index number and filed is own action. He apparently served the wife this second action and it contains a notice of automatic orders.
So 'the divorce' is not in progress. The first one is gone and a second one with the parties switched around is now on. You can go on ecourts to track its progress. You'll need the index number and the names of the parties. Note that ecourts does not pick up these cases until the RJI is filed.
Its sounds like the original divorce action was withdrawn by the wife, and that your friend has now filed for divorce on his own. This appears to be a new action.
