My child's father has not made his court ordered weekly child support payments. His employer has not been deducting it from his pay so the father has taken advantage of pocketing the money rather than making the payment to me to help in supporting our child. He wants 50/50 custody. Is there any way or thing I can do later on in court to show that he isn't even supporting him now or being responsible so how do I know my son will be taken care of if he's with him 50 % of the time. There has to be something I can do to use this against him later on to support my case for non Payment.
Child Support and timesharing are two separate issues, you can make that argument, but the court are supposed to consider these issues separately. You can file a motion to hold him in contempt for failure to make his child support payments, and can be reimburse for any attorney's fees you have • incurred.
