I live in California. I own my townhouse and my neighbor is a renter. They have been there approximately 5 months are are constantly slamming cabinets and doors causing our adjoining wall to shake. I have over 60 videos with various bumps and slamming. The HOA wants to set up a mediation with myself and the renter, homeowner and property manager. The HOA seems to be biased for the family since I’m a single female. Do I should and include them in the lawsuit since they are complicit in this?
Yes, include the HOA, though the person primarily responsible for any harm done to you is the owner of adjacent property. It's the mediator's job to help sort things out. Mediation is an excellent way to approach this kind of problem. You have input on mediator selection - what does that look like in this case?
