I am behind on rent, but I live in a mobilehome that is owned by my mom and she's deceased. the property management manager onsugh has never said anything about rewriting a renters agreement. can they make me leave and take my home in lieu of 2 months behind space rent
Your legal issues are controlled by the procedures set forth in the California Mobilehome Residency Law (California Civil Code sections 798 et al.). Here is a helpful link: http://www.hcd.ca.gov/codes/mp/2014_MRL.pdf Check out section 798.75, as it sounds like you are not a lawful occupant at this time. If you are now the legal owner of the home via a will or otherwise, then you need to enter into a rental agreement to become a lawful occupant.
I suggest that you immediately consult with an attorney to advise you regarding your rights. The CMRL is poorly written, leading to many differing opinions on the rights and responsibilities for management and tenants.
