Our 'neighbor' purchased house next door to ours 10/2011 and has bullied and harassed us and another neighbor who has two dogs, he left hand written letters in our mailboxes, screamed, cursed and has yelled at us. Long story short; he calls police, code enforcement and animal control weekly (7 months now) the authorities have not witnessed her barking in nuisance manner- she has bark/shock $&&/$/) collar and he videotaped her last week. We did not see video but were cited $168.00.
How can we fight this citation and stop him once and for all? All neighbors agree she Is not nuisance barker.
The video may be enough to be evidence sufficient for the code to be validly enforced. You could challenge it in court by setting a hearing on the ticket and fighting it.
I would seriously contemplate at least having a free initial consultation with an attorney. The videotape will be damaging to your case.
You really need to speak with an attorney as this is now not a self-help situation. The Florida Bar Association can give you a referral: www.floridabar.org/
If we do not have a signed fee agreement I am not your attorney and this is not legal advice.
