I am needing to change the jurisdiction of the court hearings for my family court case from Monterey to Los Angeles. What form (specifically) do I need to download and where am I able to find to file with the Monterey court?
Specifically, you need to file a "Notice of Motion" (for Change of Venue) with the "Application for Order and Supporting Declaration", and you need to show the court that it will be substantially inconvenient for the parties and/or the witnesses if the case remains in Monterey; you need to put specific facts in your declaration to prove this by following the guidelines posted by Atty Straus (link - Change of Venue) above.
These forms should be on the court's website: www.monterey.courts.ca.gov; click on "forms" at the top bar, click on judicial council forms at the bottom and select "Family Law - Motions and Attachments" for the group
If you cannot find these answers on line at the courts' web sites you need to go to the court an ask the self help desk, See the link below for a helpful description of the process,
Be aware that if this Motion for a Change of Venue is contested, and if you loose, you may end up having to pay the other side's attorney fees. Be certain before filing.
