We are looking at putting the retirees under the same group health plan with the same carrier, but as a separate division with a separate plan design. The active employee division would actually have a high deductible with deductible reimbursement funded by the employer. The retiree plan would be a lower deductible plan without any reimbursement.
At the heart of this matter there are at leastr two different and complicated laws; ERISA and HIPAA (non-discrimination component). Although you can find an attorney who can advise you in this area, your insurance carrier will be faster and cheaper.
