Regarding Form CIV-110 (Request For Dismissal), page 2, sentence #3 reads "[ ] All court fees and court costs that were waived in this action have been paid to the court (check one): [ ] Yes [ ] No."
I requested the court to waive the petition fees, but I haven't had my hearing yet, and I am cancelling my petition. Which boxes, in this sentence #3, should I check?When I filed my petition, I completed Form FW-003 "Order on Court Fee Waiver", and the clerk filed it officially. Because this form was filed, does it count as the fees having been waived? I need help with which boxes to check for sentence #3 on page 2. Thank you.
Just because you applied for a fee waiver application does not mean that your fee waiver application was approved. Therefore, if you are dismissing the case/petition before the court has ruled on your fee waiver application was granted, on the first page in response to Question 2, check the "did not" box and do not fill out page 2.
