My husband physically abused me, he was arrested but bailed out by his parents the next day. I left the home when I was informed of his bail , because I didn't feel safe there, and didn't know what would happen. I have no access to funds. He and his parents also took my vehicle. Then he refused to let me get my belongings. on the day of his court which was the day we arranged for me to be able to get my belongings without any confrontation
,his parents, the owners of the house, changed the locks and I no longer have access to the house.the house was purchased by his parents in agreement for us to rent to own. there is no paperwork stating there was an agreement made between my husband and I and his parents. due to the fact that they kept delaying the actual signing of the lease.
You could file a Request for Domestic Violence Temporary Restraining Order. There are no filing fees associated with such a request if actual violence is alleged, as you indicate is the case in your situation. If the Court grants your request, you will have a temporary restraining order for your protection and typically the Court will make a provision for you to obtain your personal items, should you make such a request. However, in order to divide any community property, you will need to file a divorce proceeding and make the proper request for orders. Good luck to you.
