I had a very complex divorce case in Monterey Superior Court. My ex made a bunch of baseless allegations against me that my attorney proved were false. She has been on supervised visitation since 2014. Now she is filing another motion to change custody making more allegations. My former attorney moved to San Diego and doesnt do family law anymore. Every attorney I speak with says they are conflicted out because she consulted them. What do I do?
Bring in a ringer. There are lawyers and other counties who may be just as prepared to take your case on as those nearby. End it occurs to me that there are probably lawyers he or she hasn’t gotten to because there are a lot of lawyers in the state of California. You may have to just keep looking.
PS this is called conflicting out the other lawyers.
Continue searching for an attorney who does not have a conflict of interest.
However, just remember that in order for your ex to request that a current court order regarding child custody and visitation be changed, she has to show/evidence/cite a significant change of circumstances (and couple that with arguing what is in the best interest(s) of your minor child or minor children involved).
