My husband and I are purchasing a house my name was on all the paper work at first but we hit a rough spot in our marriage and He changed all the paperwork to his sisters name without my consent is this legal in Texas ?
If you are married he can buy a house in his name but you likely own half of his interest. If his sister is helping pay the mortgage and if she's on the deed, she probably owns her share, but if the deed is in his name, not hers, she may not own an interest. It's a little cloudy here. Sounds like divorce is very likely and if there is no equity in the house it won't matter much because the bank will really own the house. Usually a $200,000 house with a $180,000 mortgage is not worth fighting for as the real equity after a sale will be near zero.
