Got my green card in 2013, in 2008 I was charged with possession of marijuana under a gram and paraphernalia, I never filed a i601 but disclosed disposition for it during my interview in 2013, I was granted my green card but now I am filling for citizenship I am told that they made a mistake by granting me the green card because I never filled the i601.. can I file it now and do I need to. The IO that interviewed me for n400 asked me if I ever filled the i601 and I said I didn't because I wasn't aware that I have to.. it's been more than 120 days since my interview and at a infopass yesterday they said they are waiting on FBI fingerprints to come back to make a decision.. what should I do?
You may be able to request a waiver nunc pron tunc (now for them) to try to cure the problem retroactively.
