Mall security took a report and took pictures of floor and my wife knee and back as she was soaked from the liquid. I took her to our local clinic and they took xrays of her knee. ( knees were replaced two years ago) the xrays showed what could be a space where there should not be one. The xrays are being sent to the surgeon who did the replacement. Her knee is still in some pain, with a black and blue area. Should I contact a local attorney.
Yes, immediately have your wife contact a local attorney to secure needed evidence before it is destroyed by the mall operators.
Without delay!! You may also wish to refrain from washing your wife's clothing (that she fell with) to see if you can determine the liquid that caused her fall. These types of cases usually turn on notice, if the mall knew or should have known the floor was wet. Contact a local attorney as soon as practicable so notices to prevent spoliation of evidence can be sent out immediately. Video coverage which may exist should be preserved as it may show that the floor was wet for a significant period of time, in essence establishing the merits of the case. Alternatively, it may show mall personnel walking in the area as it was wet and failing to cordon the area off or put up warnings/cones etc. It may even show that the condition was created by mall personnel!! Good luck
You definitely need to hire an experienced personal injury attorney if the fall compromised the knee replacement. I had my hip replaced a month ago and am super-sensitive to the prospect of having to go back in after a joint replacement surgery.
Most personal injury attorneys provide free consultations and work on a contingent basis. Email attorneys this weekend and set up teleconferences for Monday. AVVO has a tool to help you find one: http://www.avvo.com/find-a-lawyer
Yes, a local personal injury lawyer can investigate whether the mall was negligent.
By all means! Your wife should make an appointment with a personal injury lawyer who handles slip and fall cases. Many attorneys do not like to handle these cases so it is important that you find one with experience in this area. The most important thing, at present, is for your wife to continue to get appropriate medical treatment. Do not talk to any representative of the mall or its insurance company and your wife should avoid social media.
