My wife has completed her 6 years of H1B in early 2016 and got her H1B extension approved on her I-140. Currently she lost the job and would like to convert to H4 EAD.
1. Her employer will be canceling her H1B, so will she be able to change her status from H4 back to H1B if in case H4 EAD rule gets discontinued?
2. Can she apply for this change of status from H4 to H1B any time of year?
This has worked for other people. Talk to your attorney to make sure it will work for her.
