Can she give me money and let her use that as gifts against me to deduct from what I’d be entitled to in spousal support. I’m representing myself and I know they are taking advantage but if they were together on that the whole and major my wife look innocent can they do that legally without violating anything?
You really should do a consultation with an experienced divorce attorney in your area. It may be that what you believe are gifts are really contributions to support or those may not be. This is very fact specific and may depend on exactly how it is handled.
I would suggest to you that you should be very cautious about anything your wife promises because if it is not in writing, it is not enforceable.
It does not appear that your wife or her attorney are doing anything wrong. You are the one who has chosen to be unrepresented.
