He has been married to my mom for over 10 years. Because of his age, dimentia and other health problems she had to put him in a nursing home. we resently found out that his biological daughter took him out of the nursing home for a couple of hours with out my mothers concent, she was also given financial and personal information with out asking my mother if it was ok. Is there anything we can do?
This is not necessarily nursing home abuse. I would recommend you consult with a guardianship attorney and investigate your options. You may wish to go to court, have him declared incompetent and have his wife appointed as his legal guardian.
Nothing in this answer is to be interpreted as legal advice. I would need more facts to fully assess your case. This does not establish an attorney-client relationship.
Who has guardianship over him? If your mother is healthy she should petition the court for guardianship.
Make sure no wrong doing was done and if there was rectify it.
Not sure about a case against her for giving out his information.
