They have been paying us $240.00 per month in cash and there is no rental agreement. What are our legal rights to get them out of our home.
It appears that they are on a month to month lease, which allows you to evict them with 30 days notice. Send them immediately in writing, and an email constitutes a good writing with an excellent paper trail. Also post it and handed to them for extra measure. If they are belligerent and will not leave, you can certainly file a rent and possession suit, which will get them out however they can come to court with the money owed and stay. Alternatively, you can file a suit for unlawful detainer, which is more certain to get them out, however may take a bit longer, particularly with the changes to the law this year that were done rather sloppily by the Missouri legislature. Perhaps consulting an attorney may be your best bet, many of us here on although in this section have done many manysuch suits. Good luck
