I'm a non-resident alien by immigration status. My SSN has been tied with the work authorization and now the work authorization has expired. Now I'm not eligible for the EAD.
I still wish to pay my taxes.
Can I still use the SSN or do I have to file W7 form for Individual Tax Identification number for paying my taxes next year?
The reason I'm asking is that the IRS says non-resident aliens cannot have SSN and ITIN at the same time. I don't want to do the mistake by filing for TIN with the non-Active SSN as it can be regarded as fraud by the authorities
I suggest you consult an immigration lawyer first to remedy the current situation and prevent unintended consequences. Good luck. Zaher Fallahi, Tax Attorney, CPA.
