they started dating a year ago and parent were ok with it and now that he is 18 they want to threaten him with stagatory rape. she is 16 turning 17 this year... rcan he be charged with stagatory rape?
In California, sexual intercourse with a minor is against the law, even where both parties are minors. Thus, if the two engaged in sexual relations, they could both face some trouble. However, NOW that your son is no longer a minor, he better keep the relationship completely platonic. That is, he better not send her any sexual messages or engage in anything that can be perceived as sexual. If he gets charged and convicted of statutory rape, his life will never be the same. It's not illegal for an 18 year old to date a 17 year old. It happens all of the time. But the chance of your son thinking with the wrong part of his body is probably pretty good.

Dating as in going to movies , dinner, etc. is ok. Sex of any type is not. That includes touching for the purpose of excitement whether or not intercourse happens. And it does not matter who does the touching.
