I'm currently in the process of getting married to my youngest son's father. The child has my last name and I have full custody of the child. Does he have to wait a year to adopt him and have his last name changed? He went into court and admitted that the child was his so his name is on the birth certificate. The child is just in my custody and has my last name.
Once you and he get married, custody isn't an issue. Since he is already your son's father, he doesn't need to adopt him, just file in probate court to change your son's name to his father's.
